Terms of Use
Website use, SMORTLER services, original works, and the rights associated with Violet and Violet-SI.
Who these Terms cover
These Terms of Use apply to SMORTLER-operated websites, services, and published materials that link to this page, and to SMORTLER-provided features on other websites where these Terms are expressly adopted (collectively, the Sites). SMORTLER may also provide software, hosting, design, maintenance, or other technical services to independently operated websites.
When a Site is owned or operated by another organization, that organization remains responsible for its own content, users, business decisions, records, and legal obligations. Linking to this page does not transfer its ownership, copyrights, or data responsibilities to SMORTLER. Any Site-specific terms, service agreements, or mandatory legal requirements may supplement or take precedence over these general Terms.
Using the Sites
You may access publicly available pages for ordinary viewing and personal reference, subject to these Terms and applicable law. Any access to accounts, software, downloads, APIs, or restricted information requires the permissions stated for that feature.
Access does not grant ownership or an unrestricted license to copy, repackage, sublicense, sell, or distribute Site content. If you do not agree to applicable Terms, discontinue use of the affected Site or feature. Some services may require separate written or electronically accepted agreements.
SMORTLER software, hosting, and professional work
SMORTLER's work may include software engineering, websites, systems integration, databases, automation, security-minded engineering, technical guidance, graphics, written documentation, hosting, maintenance, and related services. This page is not a substitute for a project proposal, statement of work, service-level agreement, license, or signed contract.
Ownership of commissioned deliverables, client information, pre-existing tools, source code, and licenses is determined by the applicable written agreement and law. SMORTLER may retain rights in its independently developed methods, reusable components, original code, documentation, and branding where those rights have not been assigned or licensed exclusively. Conversely, work created or hosted for someone else does not become SMORTLER property merely because SMORTLER built or hosts the system.
Copyright, content, software, and designs
Original text, technical guides, code, interface designs, diagrams, photography, illustrations, creative arrangements, logos, audiovisual material, and other protectable works published through SMORTLER are reserved to their applicable authors and rights holders, including SMORTLER where it owns those rights. Third-party content remains the property of its respective owners. Public-domain material, facts, general ideas, and other unprotectable subject matter are not claimed as exclusive copyrights.
Unless a written license or law permits otherwise, you may not reproduce substantial protected content, remove attribution or copyright notices, redistribute source code, sell or falsely rebrand SMORTLER material, or imply that SMORTLER endorses a third-party product or service. All rights not expressly granted are reserved, subject to fair use and other lawful exceptions.
Violet and Violet-SI - character and brand rights
Violet and Violet-SI are distinctive SMORTLER-associated robotic character identities appearing in artwork, interface elements, guides, software experiences, demonstrations, and promotional material. Their recognizable visual designs may include original white robotic casing, a single violet eye, distinctive cable and arm treatments, orange SI insignia, human-created drawings, and human-authored artwork or arrangements.
SMORTLER and/or the applicable creators and rights holders reserve their lawful rights in the original, eligible human-authored expression and distinctive branding associated with these characters, the SI design and logos, and derivative works in which those rights subsist. No public display grants permission to reproduce the characters for merchandise, commercial branding, products, promotions, impersonation, or misleadingly affiliated works without appropriate authorization.
The names Violet and Violet-SI and related identifiers may also be protected by applicable trademark or unfair-competition principles based on actual use. This statement does not claim that any mark is federally registered.
AI-assisted content and copyright filing
Some visual or written material on the Sites is created with assistance from generative AI systems. Copyright protection is asserted only for material eligible for protection under applicable law, including sufficiently original human-authored elements, selection, arrangement, and creative modifications. SMORTLER does not claim exclusive copyright in purely AI-generated expression lacking the required human authorship.
A U.S. Copyright Office application has been filed concerning identified human-authored aspects of Violet-related artwork. Filing an application is not the same as receiving a registration, and the filing does not establish copyright in every AI-assisted image or depiction. SMORTLER and the applicable creators reserve their existing rights while registration matters are reviewed.
Prohibited conduct and automated extraction
You must not access accounts or data without permission; bypass authentication, security, rate limits, or access restrictions; introduce malware; disrupt services; impersonate another person or business; or obtain, expose, or misuse nonpublic information.
Except as expressly authorized by law or written permission, you must not systematically copy protected Site material, harvest private records, or use protected SMORTLER content, artwork, source code, or character assets as source material for commercial datasets, AI model training, fine-tuning, or unauthorized commercial imitations. Legitimate search-engine indexing of public pages is not prohibited when consistent with the Site's published access controls. Nothing here limits activities protected by applicable law, including fair use or authorized security research.
Accounts, restricted areas, and privacy
Account holders must provide accurate information when required, safeguard credentials, and promptly report suspected unauthorized access to the responsible Site Operator. Member-only content, internal documents, account data, and administrative functionality must be used only by authorized people.
Information practices are described in the Privacy Policy and any more specific notice provided by the relevant website or service. Linking to shared policies does not combine user accounts or databases across independently operated sites.
Your submissions, feedback, and permissions
You keep any rights you hold in original content you lawfully submit through a Site. By submitting material, you permit the applicable operator and its authorized service providers to use, store, transmit, and process that material as reasonably required to deliver the requested feature, administer the service, respond to you, and comply with law, subject to any applicable privacy notice or separate agreement. This permission does not automatically assign ownership.
Do not submit material you lack permission to share, including confidential client information, copyrighted content owned by someone else, or credentials. Unsolicited feedback may be considered, but confidential treatment or compensation is not established without a separate agreement.
HowTos, examples, and professional information
Scripts, configuration examples, security guidance, technical articles, calculations, and demonstrations are educational reference material. They may be incomplete for your environment and do not guarantee a particular result. Verify current documentation, permissions, dependencies, and backups; test changes before applying them to production systems.
Information on legal, financial, medical, security, governance, or other regulated matters is general information and not a substitute for advice tailored to your circumstances from an appropriately qualified professional.
Third-party links and services
Sites may include links, media, widgets, integrations, payment services, communications services, or embedded content from other providers. Those providers may have their own terms and privacy notices. Providing a link does not necessarily imply SMORTLER endorsement, control, or ownership.
When third-party services or a client-operated Site have their own payment, subscription, refund, membership, or transaction rules, the applicable provider's or operator's separate terms govern those matters.
Changes, access, and availability
To protect users and systems, the responsible operator may change features, correct content, limit abusive use, disable unsafe functionality, or suspend unauthorized access, consistent with applicable law and agreements. No particular uptime or continuous access is guaranteed by these general website Terms; any contractual service level must be stated in a separate written agreement.
Disclaimers and responsibility
To the extent permitted by law, public informational content and website access are provided on an "as is" and "as available" basis, without a promise that every example, link, or feature is suitable, complete, error-free, or continuously available. Applicable written service agreements govern commitments and remedies for professional work.
Nothing in these Terms excludes liability or consumer, privacy, accessibility, intellectual-property, or other rights that cannot lawfully be limited. The allocation of responsibility between SMORTLER, a client, a service provider, and an independent Site Operator depends on their actual roles, the law, and their contracts.
Changes to these Terms
These Terms may be updated for operational, legal, or service reasons. The effective date on this page identifies this version. Where notice or consent is required by law or a binding agreement, the responsible party must provide it. Updates do not retroactively override vested rights or executed contracts.
Licensing, permissions, and questions
